The firm's
practice areas

N. Ben Haim Law Office represents companies, developers, contractors and business owners in the courts, in arbitration and before the authorities, and advises them on transactions and day-to-day matters. Four areas, one approach: in every case we also weigh the business question, what the proceeding will cost, how long it will take and what the risk is.

Area 1

Litigation

Representing clients in the courts and in arbitration across a wide range of legal fields, with particular expertise in construction disputes, commercial disputes, and administrative proceedings in planning and building

Litigation is a craft, and a specialty in its own right: building the case, the evidence, cross-examination in the courtroom and the strategy through to the decision. The firm represents companies, developers, contractors and business owners, as plaintiffs and as defendants, in the courts, in arbitration and before appeals committees, across a wide range of legal fields and in complex, large-scale cases. Each proceeding is built around the result the client needs, not around the proceeding itself.

Services:

  • Commercial disputes: breach of contract, supplier-customer disputes, partner and shareholder disputes
  • Construction and contractor disputes: final accounts, variations and additions, forfeiture of performance guarantees
  • Construction defects and late delivery: claims under the Sale (Apartments) Law, including on behalf of groups of buyers
  • Real estate disputes: ownership, co-ownership, registration and purchasing groups
  • Administrative petitions and appeals: against local authorities, planning bodies and state authorities
  • Arbitration and mediation
  • Commercial debt collection: from the demand letter to enforcement
Area 2

Real Estate, Planning and Building

Real estate transactions, urban renewal, moshav farms and cooperatives, building permits, objections and planning committees

We guide transactions and projects from negotiation to registration, and represent clients before the planning authorities at every stage: from the permit application, through objections, to appeal. Our clients include developers, contractors, landowners and buyers, among them owners of farms and holdings in the agricultural sector.

Services:

  • Real estate transactions: buying and selling apartments, land and commercial property
  • Urban renewal: representing apartment owners and developers
  • Agricultural land: farms and holdings in moshavim, and rights vis-à-vis the Israel Land Authority and the cooperative
  • Building permits and plans: representation before local and district committees
  • Objections to plans and permit applications
  • Appeals against local committee decisions before the planning and building appeals committees
Area 3

Commercial Law and Ongoing Counsel

Commercial contracts, founders' and shareholders' agreements, ongoing counsel to companies and non-profits, and employment law for employers

Ongoing legal counsel to companies, non-profits and business owners: drafting contracts and agreements, ownership structures and continuity arrangements, employment relations, and handling disagreements before they become proceedings. This area complements our internet, technology and media practice, and together they give a business a legal envelope for its day-to-day activity, from contracts and employment relations to privacy and intellectual property. Our litigation experience shapes our drafting: agreements are written knowing how a court will read them, and when a disagreement reaches proceedings, we represent the client in court as well.

Services:

  • Commercial contracts: drafting, review and negotiation
  • Founders' and shareholders' agreements, articles of association and continuity arrangements
  • Ongoing counsel to companies and non-profits: advising management and the board
  • Employment law: representing employers, employment agreements and termination
  • Legal opinions for companies and boards of directors
Area 4

Internet, Technology and Media Law

Privacy and databases, website terms, copyright and trademarks, and media crisis management

The firm has particular expertise in internet, technology and media matters that commercial companies deal with on an ongoing basis. We advise companies, websites and digital platforms on the legal side of their activity: privacy and databases, terms of use for e-commerce sites, and day-to-day intellectual property matters. Alongside this, the firm specializes in media crisis management, drawing on Adv. Ben Haim's extensive experience in the media: legal support for individuals and organisations facing a harmful publication, from the moment it appears to the proceedings in court.

Services:

  • Privacy and databases: privacy policies, data security and the duties under Amendment 13 to the Privacy Protection Law
  • Website and app terms: terms of use and privacy policies
  • Copyright and fair use
  • Trademarks and trade secrets: registration and protection against infringement
  • Media crisis management: legal support against a harmful publication, including defamation and privacy claims, representing plaintiffs and defendants, and removal of publications from social networks and websites
